9. Force Majeure
Ultra Bike Supply shall not be held liable in case of non-performance or delay in the performance of any of its obligations described in these terms of service due to a force majeure event. Force majeure, in contractual matters, is understood as an event beyond the control of the debtor, unforeseeable at the time of the conclusion of the contract and whose effects cannot be avoided by appropriate measures, preventing the execution of its obligation by the debtor. In case of temporary impediment, the execution of the obligation is suspended, except when the resulting delay justifies the termination of the contract. In case of permanent impediment, the contract is terminated by operation of law, and the parties are released from their obligations in accordance with the provisions of articles 1351 and 1351-1 of the civil code. In the event of the occurrence of any of the aforementioned events, Ultra Bike Supply will endeavor to inform the registered user as soon as possible.
